Please read these Terms and Conditions (“Terms“) carefully before using the PassTheBar.ca website (the “Site“) operated by PassTheBar.ca (“we,” “our,” or “us“). These Terms apply to all visitors, users, purchasers, and others who access or use the Site. By accessing or using any part of the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use or access the Site.

1. Educational Purpose and No Affiliation Disclaimer

PassTheBar.ca is a privately operated educational platform created to support candidates preparing for the Ontario Bar Exam and related Canadian legal qualification assessments. We provide simulated practice exams, study aids, and content for educational and preparatory purposes only.

We are not affiliated with, endorsed by, or connected to the Law Society of Ontario (LSO), the Federation of Law Societies of Canada, or any Canadian legal regulatory body. Nothing on this Site constitutes legal advice or guarantees your success on any official bar examination.

Use of this Site does not create a solicitor-client relationship or any other fiduciary or professional relationship.

2. Eligibility

By using this Site, you represent and warrant that you are at least the age of majority in your province or territory of residence and are legally capable of entering into binding contracts.

3. User Accounts

You may be required to create an account to access certain features of the Site. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, complete, and current information and to update such information as necessary. We reserve the right to suspend or terminate accounts at our sole discretion.

4. License and Use of Content

All content made available through this Site, including but not limited to exams, questions, explanations, text, graphics, and logos (the “Content“), is the intellectual property of PassTheBar.ca or its content providers and is protected by Canadian and international copyright and intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its Content solely for your personal, non-commercial, educational use.

You may not:

Reproduce, distribute, modify, display, perform, publish, transmit, or otherwise exploit any part of the Site or Content without prior written permission;

Share, resell, or sublicense access to our exams or account features;

Use automated means (such as bots or scrapers) to access the Site;

Circumvent any access or security restrictions on the Site.

5. Purchases and Refund Policy

All purchases made on PassTheBar.ca are final and non-refundable, except where required by law. Products are digital in nature and provide immediate access upon purchase. By purchasing any product or service, you agree to the pricing and billing terms at the time of purchase.

We reserve the right to change pricing or modify access terms at any time without prior notice, but such changes will not affect existing transactions.

6. Exam Simulations and Accuracy of Materials

PassTheBar.ca offers timed practice exams intended to simulate the structure and complexity of the Ontario Bar Exam. However, we do not warrant that:

The questions provided exactly replicate those on any official examination;

The content reflects the most current legal developments at all times;

Use of the Site will result in passing any bar examination.

It remains your responsibility to verify that your study materials align with current rules and syllabi issued by the relevant law society.

7. Availability of Services

We reserve the right to modify or discontinue, temporarily or permanently, the Site or any part of its services without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuance.

We do not guarantee uninterrupted access to the Site or that it will be free from errors or omissions.

8. Limitation of Liability

To the fullest extent permitted by applicable law, PassTheBar.ca, its owners, affiliates, employees, agents, and representatives shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or relating to your use or inability to use the Site.

In no event shall our total aggregate liability exceed the amount paid by you, if any, for the services accessed within the six-month period preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless PassTheBar.ca and its affiliates, officers, directors, agents, and employees from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with:

Your access to or use of the Site;

Your violation of these Terms;

Your violation of any third party rights, including intellectual property rights.

The Site may contain links to third-party websites or services that are not owned or controlled by PassTheBar.ca. We do not assume responsibility for the content, privacy practices, or policies of any third-party websites.

Your use of such third-party services is subject to their terms and policies, and you access them at your own risk.

11. Termination

We reserve the right to terminate or suspend your account and access to the Site at any time, without notice or liability, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties.

Upon termination, all rights granted to you under these Terms shall cease.
